Terms of use
1. About these terms
These terms are an agreement between you and Lloyd Nicholson ("Road Badger", "we"). By tapping "Agree and start" or using Road Badger, you accept them. If you don't, please don't use Road Badger. Our privacy policy explains how we handle your information.
2. Road Badger is independent
Road Badger is independent and not affiliated with the City of Johannesburg or its entities. Road Badger is not a municipal service and not an official channel of any government body. We send your report to the desk we believe is responsible, as a resident would. Names of municipal entities appear only to say where a report was sent.
3. What Road Badger does, and what it can't promise
- Road Badger turns your spoken report into a written one, finds the road, sends it to the desk responsible, and follows it up.
- Whether and when a fault is fixed is up to the municipality or entity responsible. We can't promise a fix, a reference number or a reply.
- Road Badger may get the road, the spot or the responsible desk wrong. Check the read-back before you confirm.
- Road Badger is free. If paid plans are added, their price and terms will be shown before you pay, and payment goes through the app store.
4. Not for emergencies
Road Badger is not an emergency service. If someone is hurt or in danger, call 10111 (police), 10177 (ambulance) or 112 from a cell phone. For a fallen live wire or other immediate danger, call the emergency services first.
5. Stay safe on the road
Road Badger is designed to be used by voice, with one press, so you can keep your eyes on the road. Obey the road traffic laws: don't hold or look at your phone while driving. If it isn't safe to report, stop first or report later.
6. Your reports
Report real faults, honestly. Do not:
- make false, misleading or repeated reports, or claim something is fixed when it isn't;
- include abusive, threatening or offensive words, or personal information about other people;
- photograph people's faces or number plates on purpose, or anything other than the fault;
- use Road Badger to harass officials or anyone else, or to send anything unlawful;
- try to break, overload, copy or reverse-engineer the service.
We may hold back, edit out personal details from, or remove a report that breaks these rules, and limit or close an account that keeps breaking them.
7. Your photos and recordings: the licence you give us
You keep ownership of what you record, write and photograph. By submitting a report, you give Road Badger a non-exclusive, royalty-free, worldwide licence, lasting as long as the fault record is kept, to store, copy, crop, blur and use your report's words and photos in order to:
- send them to the municipal desks and other bodies responsible for the fault, and follow it up;
- show the fault, without saying who reported it, on Road Badger's map and fault pages;
- show Road Badger's results publicly, for example a "reported Monday, fixed Thursday" before-and-after picture on our site or social media.
We will only feature your photo publicly (the last point) if you opt in for that fix, and we always blur faces and number plates first. We never sell your photos. Your voice recording is not covered by this licence: it is deleted once your report is placed (see the privacy policy). You confirm you have the right to share what you submit.
8. Desk track records
Road Badger shows how desks respond to reports (for example, how long they take to log a fault and how many faults residents confirm fixed). These figures come from the reports and replies Road Badger has seen; they are not an official measure of any body's performance.
9. Liability
Road Badger is provided "as is". As far as the law allows, we are not liable for any loss caused by a fault, by a delay or failure to fix it, by a report sent to the wrong desk, or by the service being unavailable. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.
10. Ending
You can stop using Road Badger at any time and delete your details in Settings. We may change or stop the service; if we stop it, we will try to give notice in the app.
11. Changes and law
We may update these terms; the date above shows when. If a change matters, the app tells you before it applies. These terms are governed by the law of South Africa.
